RESUME

Les conflits armés sont souvent accompagnés de violations du droit international humanitaire (DIH). Ces conflits peuvent être internationaux, opposant plusieurs États, ou non internationaux, impliquant des groupes armés au sein d’un même État.

L’étude du sujet « Les attaques des belligérants dans les conflits armés » soulève la question de l’étendue du droit des belligérants à mener des attaques. Si attaquer est un droit pour les belligérants, ce droit n’est cependant pas absolu, les attaques doivent être mesurées. Les belligérants ne disposent pas d’une liberté totale dans la conduite de leurs opérations ; ils doivent strictement respecter les règles et principes du DIH.

La résolution de cette problématique invite à examiner deux aspects : la réglementation du droit des belligérants à mener des attaques mesurées et la justification de cette réglementation. Selon le DIH, les attaques doivent être dirigées exclusivement contre des objectifs militaires, qu’ils soient humains ou matériels. Une attaque est jugée légitime si l’objectif visé contribue effectivement à l’action militaire de la partie attaquée et si sa neutralisation, sa capture ou sa destruction procure un avantage militaire précis et concret à l’assaillant.

Cette réglementation trouve sa justification dans la recherche d’un équilibre constant entre impératifs militaires et considérations humanitaires. Cet équilibre, essentiel au DIH, demeure néanmoins difficile à atteindre, tant les dynamiques des conflits modernes évoluent et remettent en question l’application stricte des principes établis.

ABSTRACT

Armed conflicts are often accompanied by violations of international humanitarian law (IHL). These conflicts can be international, pitting several states against each other, or non international, involving armed groups within the same state.

The study of the topic « Attacks by Belligerents in Armed Conflicts » raises the question of the scope of the belligerents’ right to attack. While attacking is a right for belligerents, this right is not absolute. They do not have complete freedom in the conduct of their operations; they must strictly respect the rules and principles of IHL.

Resolving this issue calls for an examination of two aspects: the regulation of the belligerents’ right to attack and the justification for this regulation. According to IHL, attacks must be directed exclusively against military objectives, whether human or material. An attack is deemed legitimate if the intended objective effectively contributes to the military action of the attacked party and if its neutralization, capture, or destruction provides a specific and concrete military advantage to the attacker.

This regulation is justified by the search for a constant balance between military imperatives and humanitarian considerations. This balance, essential to IHL, nevertheless remains difficult to achieve, as the dynamics of modern conflicts evolve and call into question the strict application of established principles
